THE REGIONAL MUNICIPALITY OF WATERLOO POLICE SERVICES BOARD BY-LAW NUMBER 17-01

Being a By-law to establish fees and charges for certain services and to repeal By-law 04-01 of The Regional Municipality of Waterloo Police Services Board, as amended

WHEREAS The Regional Municipality of Waterloo Police Services Board passed By-law 04-01 at its meeting on December 9, 2004 to impose fees and charges for certain services provided by The Regional Municipality of Waterloo Police Services Board and such By-law was approved by resolution of the Council of The Regional Municipality of Waterloo at its meeting on December 15, 2004;

AND WHEREAS By-law 04-01 was subsequently amended by By-law 07-01 passed by The Regional Municipality of Waterloo Police Services Board at its meeting on February 7, 2007 and such By-law was approved by resolution of the Council of The Regional Municipality of Waterloo at its meeting on May 2, 2007;

AND WHEREAS By-law 04-01 was further amended by By-law 08-01 approved and passed by The Regional Municipality of Waterloo Police Services Board on May 21, 2008;

AND WHEREAS The Regional Municipality of Waterloo Police Services Board has deemed it desirable to set out its fees and charges for services in this by-law and repeal By-law 04-01, as amended;

NOW THEREFORE, The Regional Municipality of Waterloo Police Services Board hereby enacts as follows:

PART 1 -SHORT TITLE

  1. This By-law may be cited as the Fees and Charges By-law.

PART II - DEFINITIONS

  2.  "Board" means The Regional Municipality of Waterloo Police Services Board.

PART Ill - GENERAL

  3. (1) The fees and charges for various services are shown in Schedule "A" attached hereto and are subject to H.S.T. 

           where applicable.

      (2) The definitions and terms for alarm services are shown in Schedule "B" attached hereto.

      (3) The fees and any applicable taxes will be payable to the Board within thirty (30) days of the date of an invoice for such

           fee from the Board.

      (4) Interest on any past due accounts will be 12% per annum.

      (5) By-law 04-01 of The Regional Municipality of Waterloo Police Services Board, and any amendments, shall be repealed

           effective on the coming into force and effect of this By-law.

      (6) This By-law shall come into force and effect on September 1, 2017.

SCHEDULE "A"

 

To By-law 17-01, being a By-law to establish fees and charges for certain

services and to repeal By-law 04-01 of The Regional Municipality of

Waterloo Police Services Board, as amended

ALARMS

$10.00 per alarm system annually to register.

$100.00 for attending the first false alarm plus;

$25.00 an escalating fee for each additional false alarm within 365 days.

$200.00 for attending non-registered and expired registration false alarms.

$30.00 for false alarm reconsideration appeal

SCHEDULE "B"

 

To By-law 17-01, being a By-law to establish fees and charges for certain

services and to repeal By-law 04-01 of The Regional Municipality of

Waterloo Police Services Board, as amended

 

The following sections shall apply to fees and charges for Alarm Services:

1. (1) "Alarm Business" means any person or persons who engage in the business of installing

          and/or maintaining alarm systems;

    (2) "Alarm System" means any device which when activated transmits a signal or message to

          an alarm business; .

    (3) "Automatic Dialing System" means a device which when activated is programmed to

          automatically solicit a police response to an alarm condition via the telephone;

    (4) "False Alarm" means the activation of any alarm system, where in the opinion of the Chief

          of Police or designate no emergency or evidence of criminal activity exists at the premises at

          which the alarm system is installed and includes the activating or testing of an alarm

          without notification and alarms triggered by natural causes or conditions; and

     (5) "Valid Alarm" means an alarm signal which has been activated for the legitimate purposes

          for which it was installed that being a criminal act or attempt or an emergency situation

          related to the premise.

2. (1) In the event that all or part of any fees, applicable taxes and/or interest owing, under this

         By-law, by an alarm business, is outstanding for a minimum of sixty (60 days) from the date

         upon which it is due, the alarm business shall become non-registered and attendance to

         false alarms reported by the alarm business shall result in a non-registered fee for response

         to false alarm(s);

 

     (2) The alarm business shall register with the Chief of Police or designate any alarm system

          prior to the initial activation of the alarm system. Failure to pay the annual registration fee

          and register such alarm system with the Chief of Police or designate shall result in a nonregistered

          fee for response to false alarm(s); and

 

    (3) When an alarm is reported by way of an automatic dialing system, a non-registered fee for

         response to false alarm shall apply unless the Chief of Police or designate is of the opinion

         that the alarm was a valid medical panic alarm or a valid alarm.
